Jury Instructions? Don't Make Me Laugh!

Again, from Roger Shuler of legalschnauzer I found a very interesting observation to share with you.

By the way, this is not the first time I've found something comical in this serious business of following a corrupt justice department. For example, in researching the Paul Minor case in Mississippi, I was stunned to see the jury instructions regarding bribery from U.S. District Judge Henry Wingate, another Republican appointee. Here's how Wingate's instructions read, in part:"You may find specific criminal intent even though you may find that the rulings were legal and correct, that the official conduct would have been done anyway, that the official conduct sought to be influenced was lawful and required by law, and that the official conduct was desirable or beneficial to the public welfare."You don't need a Harvard law degree to understand the absurdity in these instructions. Essentially, Wingate told the jurors: "You may find the defendants engaged in criminal activity even if you determine that their actions were legal--in fact, even if you find their actions were required by law." Gee, no wonder the defendants were found guilty.That's like saying, "You may find Herman Blokes guilty of theft even though the $100 he picked up off the desk belonged to him, and therefore, it was legal for him to pick up the $100 and walk away with it."I understand that jurors tend to be obedient creatures and probably are a little bit in awe of a judge and the trappings of legal authority. But you would think someone on the Minor jury would have said, "You know, this part about being able to find someone guilty even though their actions were legal . . . somehow that doesn't sound right to me."But so far, Henry Wingate has gotten away with it. . . . Ah, justice in the Age of Rove. Isn't it grand?

I, the Gulf Coast Sur-Realist, will now comment to the legalschnauzer how Henry Wingate has gotten away with it as I was sitting in the courtroom for the full 2 1/2 days that Wingate read aloud the jury instructions. Please note the convoluted spiral of obfuscated garbage. Imagine listening to this for 2 1/2 days! Let me assure you that everyone in the courtroom, especially the jury, tuned out after the first five minutes BECAUSE THEY HAD THE REASONABLE EXPECTATION OF HAVING A COPY OF THE JURY INSTRUCTIONS TO TAKE WITH THEM TO THE JURY ROOM! With a written copy, they could have questions about absurdities like this. And guess what else. His royal highness, the judge, LEFT THE COURTHOUSE FOR A SPEAKING ENGAGEMENT WHILE THE JURY WAS DELIBERATING, THUS HE WAS NOT AVAILABLE TO ANSWER THEIR QUESTIONS THOUGH HE WAS SUPPOSED TO BE THERE! He is either too blatantly ignorant of the law to keep his seat on the bench or too corrupt to keep his seat. YOU be the judge!!!!!

Teel is a criminal. He was found guilty by a jury of his peers. Just because this is the only time he got caught, don't believe for a moment that this was his first criminal act. This guy is right where he needs to be- in prison. Teel's son Ryan carries on the family legacy of crime in top notch fashion as a brutal murderer. Like his father, Ryan had committed a long series of brutalities before beating Jesse Lee Williams to death while he was TIED DOWN IN A CHAIR WITH A PEPPER SPRAY FILLED BAG OVER HIS HEAD! Then this Animal had the nerve to testify that he was "in fear for his life" In fear... of a man strapped into a chair... with no way to even move... These two evil people, protected by the power and influence of their positions have finally been brought to justice. It's time to celebrate. The crime wave known as Wes and Ryan Teel, has finally been stopped. If Satan Himself were locked away, his crimes exposed for all the world to see, some stupid moron would probably start a blog defending "Poor Satan". This Gulf Coast Realist blog is just as ludicrous as the Devil's would be.

Wes Teel belongs in jail. This is his blog, so naturally it will be biased in his favor, but that doesn't change the character of the man, and doesn't erase his misdeeds. As a lawyer, Teel took money from clients and essentially forgot about them. Oh sure, the high profile clients were treated better I'm sure, but the regular Joe that paid his outlandish retainer was lucky if he got to even speak to Wes on the phone prior to the court date. Teel screwed me over, and did the same to a close friend of my parents as well. How does this guy sleep at night? He lived high on the hog by ripping off his clients rather than doing the job he was hired to do. Shame on you! Maybe jail will give him some time to reflect on the things he's done and the people he's hurt.

Isn't it funny that when someone states their opinion of Mr. Teel that happens to be less than flattering, some so-called Christian attacks the writer for casting stones. But isn't that "Christian" casting stones as well? It is not a sin to expose Evil. Look, if this guy Teel truly is is innocent of the crime that he's in jail for, that's a shame. But an awful lot of people have written that Teel is a less than honorable guy. These accusations have to come from somewhere. So all you Teel lovers out there- Beware! Maybe all this stuff is true. Maybe he isn't the sweet guy you think he is!

i have been before Judge Wingate...as much as i hate to say...teel is right...Wingate is a very strange judge...he is black but is very white on the inside...he truly should not be on the bench..he is  a weird dude

Thank you for using initials so you can be addressed directly. The Sur-Realist may or may not be a Christian. Anyone can read the New Testament and see the code of behavior requested by Jesus. I looked and couldn't find the verse that said anything about getting into a pissing contest with your neighbor, or the one that said to hurt him worse than he hurt you. Au contraire. It said to feel free to go ahead and heap hot coals on a sinner ONLY when you find your own doorstep free and clean of sin. I took that to mean BEFORE that born-again stuff. It's easy for us to repent just enough to be more sanctimonious than at least one other person. I see you've chosen Wes.
Dear God, you use spurious reasoning! Do you walk around in circles trying to follow your own line of thought! You have essentially said that because some people have written that Wes is less than honorable, then it must be true. YOU were one of those people, and from the tone of your writing, it sounds as if you do not know him personally and don't have an experience with him. Ergo, you may be speaking out of turn. You see, people who know Wes and know his true character don't feel they need to rhapsodize at length about him to everyone else any more than you need to write poetry about your best friend daily. It's mostly those people who didn't win in a court case associated with Wes who are disgruntled.

I wasn't referring to the Sur Realist- I was referring to you, Doodlebug. You seem to think you are in a position to judge, but others can not. What makes you so special? You judge me as an uninformed idiot who has no right to even entertain the possibility that Teel may be less than perfect, but you are free to try to convince the readers of the blog that he is sinless and Holy. And what I "have essentially said" is that if a bunch of folks have gone to the trouble of coming to this blog and expressed an opinion that shines a less than flattering light on Teel, that they may just be telling the truth. Why don't you try holding yourself to the same standard that you hold Teel's detractors to?
